Terms and Conditions
The following outlines what you get and can expect from your purchase of a “Sell Courses Online” website from Kicking Pixels.
What you see – the website. The website you purchase includes the following:
- Home page
- About page
- Courses summary page
- Individual course page template (you can duplicate this page if you have more than one course)
- Blog page
- Individual blog page template (you can duplicate this page for each blog you create)
- WP Courseware integration to sell and deliver online courses from your website, including enrolment, cart & checkout facilities for courses.
Styling your website
In order to make the website your own, we will style it by changing the 3 main colours on the website to your preferred colours, as well as your chosen Google Font, once only. Google fonts are free of charge. You will have the ability to amend these yourself once the site is live.
The contact form on your website will send an email to your nominated email address.
Your website comes with 12 months of Word Press hosting included, powered by Crazydomains, as well as a 12 months SSL certificate*. You will be contacted when this is reaching the end. Currently, this is currently $190/year +GST (AUD).
You also have the option to upgrade to WP Engine website hosting, before your website goes live, for an additional $310/year +GST (AUD).
*An SSL certificate delivers your website securely as https and is mandatory for anyway selling products or services online.
Your website will also have the WP Courseware Plug-in integrated and styled to match the rest of your website. This licence will need to be purchased by you alongside the websites to ensure you have full access to their offering.
Give you visitors the opportunity to interact with your website on their preferred device – desktop, tablet & mobile.
Your blog page will be available for you to use when you are ready to use it. This is an integral part of your website as Google loves regular and fresh content! A well structured and integrated blog page enables you to convey your expertise and share information with visitors to build trust.
Get to know your website visitors
We add tracking codes, such a FB Pixels, to your website to enable you to collect valuable information from your website visitors, enabling you to reconnect with them on their terms
Analyse and scrutinise your website
We integrate Google Analytics to your website, and will add up to 3 goals to give you valuable insights into how your website visitors arrive, what they look at, and how the leave your website.
Link to social media
Promote your social media pages and groups to engage more of your fans. We will link to your social media platforms.
Once your site is live, we make sure you have the tools to manage internal content yourself.
You will have templated pages ready for your use. You can add countless pages and blog posts, giving you the flexibility to reach out to add content and engage with your audience.
We add Google ReCAPTCHA to your contact forms to help filter SPAM contact before they reach you, to reduce the distractions.
Tested and Debugged
Your web site will be tested and debugged before going live.
We add a layer of security by enabling daily backups of your website, using Updraft Plus, to ease the pain if something does go wrong down the track.
The following lists some of the items that form part of any website but are not included as part of this package as these form part of your content. Should you require help with any of these, please speak to us about your options and estimates of the additional costs these incur.

If there is anything you need amended, added or removed, and you don’t want to do this yourself, we will be happy to quote on getting this done for you.
Website Maintenance and Care
Your website will be ready for you to go, however as with everything, looking after it is key to long term health. We offer care plans to help with this and can provide you with a checklist of items that should be looked after should you decide to do this yourself.
You will receive a 12-month licence for all updates made to Beaver Builder and Astra. After this time, you will be able to continue to use the versions you have, however you will no longer get access to updates. You have the option to purchase your own licence for Beaver Builder, and Astra Pro should you wish to continue to access updates after the initial 12 months.
WP Courseware is purchased by you initially and you will be in charge of renewing this on an annual basis should you wish to continue to use this Plug-in.
Contact Forms & CRMs
If you are using an email marketing service, we can link your contact form directly to your CRM account. As this takes additional time, an additional cost is associated with this. Please check with us if this is of interest.
Website Design & Build Terms of Business between us “Kicking Pixels Pty Ltd” (referred to as “Kicking Pixels” from here on in), ABN 13 136 066 496 and you/your business (referred to as “You” from here on in).
We will always do our best to fulfil your needs and meet your goals, but sometimes it’s best to have a few things written down so that we both know what’s what, who should do what and what happens if stuff goes wrong.
In this contract, you won’t find complicated legal terms or long passages of unreadable text. We have no desire to trick you into signing something that you might later regret. We do want what’s best for the safety of both parties, now and in the future.
“You” are hiring “Kicking Pixels” (located at Suite 4.39 Element Building, 200 Central Coast Highway, Erina, Central Coast, NSW, 2250) to design and build a Kicking Pixels “Sell Courses Online” WordPress website.
Of course, it’s a little more complicated, but we’ll get to that.
What does each party agree to do?
As our client, you have the power and ability to enter into this contract on behalf of your company or organisation. You agree to provide us with everything that we’ll need to complete the project – including text, images, and other information – as and when we need it and in the format, we ask for.
We have the experience and ability to perform the services you need from us and we will carry them out in a professional and timely manner. Along the way, we will endeavour to meet all the deadlines set but we can’t be responsible for a missed launch date, or a deadline. On top of this, we’ll also maintain the confidentiality of any information that you give us.
Getting Down To The Nitty-Gritty...
The Kicking Pixel’s “Sell Courses Online” website comes pre-designed and changes to the layout are not included in the purchase. Should you wish to amend anything, we will be happy to quote you for this work as a separate project.
We test your website on the latest supported versions of Chrome, Safari, Opera, Internet Explorer and Firefox.
We have tested this website on the latest supported versions of Chrome, Safari, Internet Explorer, Firefox and on Apple’s iPad. Other devices and/or browsers are not taken into account. Constant changes to browsers and technology means we cannot guarantee that future events won’t impact the website. We recommend a “Care Plan” package to ensure that ongoing changes are compatible with your website.
We are not responsible for writing copy for your website. We’ll be happy to help, and provide guidance. Professionally written copy can be supplied as a separate project if required
Photographs & Video
You will supply us photographs and video in digital format. If you choose to buy stock photographs or video we can suggest vendors of visual stock content (dependent on need). Any time we spend searching for appropriate photographs will be charged at our standard discovery rate.
Changes and Revisions
The “Sell Courses Online” websites are an “out of the box” solution and therefore if you require something different, we recommend chatting through your needs before starting on the project, to determine what the best solution for your needs might be. While changes and revisions can be undertaken, they do not form part of the package and we do not recommend purchasing this product with this in mind, as in our experience, this is not the most cost-effective way to build a website.
Word Press Hosting is provided for 12 months as part of the package. This is done under Kicking Pixels’ “MyWebAdvantage” brand and is powered by Crazy Domain. This hosting is held on Australian servers. Should you wish to upgrade your hosting, we offer WP Engine hosting at an additional cost.
As WordPress is 3rd party open-source software, and plugins used are also sometimes 3rd party we can’t guarantee that the functions contained in any web page templates or in a completed website will always be error-free and so we can’t be liable to you or any third party for damages, including lost profits, lost savings or other incidental, consequential or special damages arising out of the operation of or inability to operate your website and any other web pages, even if you have advised us of the possibilities of such damages.
If any provision of this agreement shall be unlawful, void, or for any reason is unenforceable, then that provision shall be deemed severable from this agreement and shall not affect the validity and enforceability of any remaining provisions.
You guarantee to us that any elements of text, graphics, photos, designs, trademarks, or other artwork that you provide us for inclusion in the website are either owned by your good selves or that you have permission to use them.
When we hand over your website, copyright is automatically assigned as follows:
You own the graphics and other visual elements that we create for you for this project.
You also own text content, photographs and other data you provided unless someone else owns them.
We love to show off our work and share what we have learned with other people, so we reserve the right to display and link to your completed project as part of our portfolio and to write about the project on websites, in magazine articles and in books about web design.
Tax receipts are presented along with GST (10%).
But where’s all the horrible small print?
Just like a parking ticket, you can’t transfer this contract to anyone else without our permission. This contract stays in place during the project and need not be renewed. If for some reason one part of this contract becomes invalid or unenforceable, the remaining parts of it remain in place. Although the language is simple, the intentions are serious and this contract is a legal document under non-exclusive jurisdiction of the courts of Australia.
